Scope of Application
Maison Éclat, based in Zurich, is an online retailer of champagne and accessories. These general terms and conditions apply to all orders placed on the website https://maisoneclat.com, in the version valid at the time of the order.
Order and Contract Formation
You place an online order in the shop. The order becomes binding once you have agreed to the General Terms and Conditions (GTC) and clicked the BUY button. This creates a legally valid purchase contract. Upon receipt of your order, you will receive an order confirmation from us via email.
Offers & Prices
Our online offer is subject to change and non-binding. Should it not be possible to deliver one or more items due to a stock discrepancy, Maison Éclat will inform you of this circumstance as quickly as possible and offer you equivalent items. If none of these items are suitable for you, the amount will be refunded.
Our sales prices are stated in Swiss Francs, including statutory VAT and shipping costs (CH only).
Prices and VAT
The prices displayed in the online shop are binding. Maison Éclat is not subject to VAT.
For items ordered on maisoneclat.com, only the prices displayed in the shopping cart immediately before submitting the order apply.
Shipping Costs Switzerland
Packaging and shipping costs in Switzerland & Liechtenstein are a flat rate of CHF 15.- (fifteen Swiss Francs). For purchases of 12 bottles or more, the order will be shipped free of charge.
Payment Options
Credit card, PayPal, Twint, and advance payment are accepted.
Advance Payment
For advance payment, delivery will only take place after payment has been received.
Products are reserved until the payment deadline of 7 calendar days. You can conveniently pay the invoice cashless within this period via postal or bank transfer.
Credit Card
You can also pay for your order by credit card (VISA, Mastercard, American Express – via Stripe.com) or PayPal. Any fees charged by the card institutions will be passed on to you.
Protection of Minors
In Switzerland, alcoholic beverages may not be sold to young people under 16 years of age, according to legal provisions. Spirits may not be sold to minors under 18 years of age. By placing an order on maisoneclat.com, the customer acknowledges these provisions and confirms that they are authorized to make the purchase. Maison Éclat disclaims all liability in case of non-compliance.
Voucher
You can pay for your order with a Maison Éclat voucher. To do this, enter the code from the voucher into the corresponding field of the order. A voucher can only be redeemed for its full amount.
The voucher amounts are predetermined. Vouchers are issued exclusively in CHF and are freely transferable.
Cash redemption is not possible.
Retention of Title
The ordered goods remain the property of Maison Éclat until full payment has been received.
Delivery Conditions and Shipping Costs
Delivery is made upon receipt of order to the invoice recipient or to a delivery address chosen by them in Switzerland or Liechtenstein. Deliveries to multiple recipients require multiple individual orders. International deliveries are not possible.
Availability
Our product range is subject to constant change, and we cannot guarantee the continuous availability of all products displayed on maisoneclat.com. If a particular champagne is not available, we will contact you.
6. Exchange/Returns
Your order on maisoneclat.com is binding. Generally, ordered champagnes cannot be exchanged or returned. Exceptions include deliveries damaged during transit and incorrect deliveries. We ask you to check the delivery for correctness and integrity upon receipt and to forward any complaints to us immediately. 7 days after receipt, the delivery is considered approved. Champagnes with "cork taint" will be reimbursed, provided the fault is detectable and the bottle is at least 75 percent full.
Data Protection
The protection of your personal data is very important to us. We comply with applicable data protection regulations and secure your data against unauthorized access by third parties (data security measures).
Our online shop is encrypted using SSL (Secure Socket Layer), ensuring that all offer data, as well as your payment and customer data, are securely transmitted to us.
Maison Éclat is entitled to use your personal data to send you special offers or information about new products. You can revoke your consent to the use of your personal data for advertising purposes at any time by sending an email to sante@maisoneclat.com.
We secure our website and other systems with technical and organizational measures against loss, destruction, access, alteration, or dissemination of your data by unauthorized persons. Access to your shopping account is only possible after entering your personal password.

Applicable Law and Jurisdiction
The contractual relationship between you and Maison Éclat is governed by substantive Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (CISG). The place of jurisdiction for all disputes is Zurich. Maison Éclat is also entitled to optionally appeal to the court at the customer's domicile/residence.
